Overview
This website, arlumia.com, is operated by Arlumia ("Arlumia", "we", "us" or "our"). Arlumia is powered by Shopify, which enables us to provide our online store and related services to you (the "Services"). By visiting our store or buying from us, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please don't use the Services.
1. Our products
Arlumia Sun-Worn Skin Body Oil is a cosmetic product. It is not a drug and is not intended to diagnose, treat, cure or prevent any disease, including actinic keratosis or skin cancer. Nothing on this website is medical advice. Keep seeing your dermatologist, and show them any spot that is new, changing, bleeding or not healing. Patch test before first use and stop using the product if irritation occurs. Statements about how the product looks or feels on skin describe cosmetic effects, and individual results vary.
We try to show our products, ingredients and colors accurately, but appearance may differ slightly on your screen. We may change product descriptions, formulas or packaging, or stop selling a product, at any time.
2. Your account and eligibility
You must be at least the age of majority where you live to buy from us. You agree that the information you give us is accurate and current, and you are responsible for keeping your account login secure.
3. Orders
When you place an order, you make an offer to buy. We may accept or decline any order, limit quantities, or cancel an order (for example, if a price was shown in error or we suspect fraud). If we cancel an order you've paid for, we'll refund you in full. Your purchases are for personal use, not resale.
4. Prices, payment and taxes
Prices are shown in US dollars and may change without notice. The price you pay is the price shown at checkout when you place your order. Any compare-at or "value" prices shown reflect the price of buying the same number of bottles separately at our regular single-bottle price. Applicable taxes and shipping are calculated at checkout.
5. Subscribe & Save (automatic renewal)
If you choose Subscribe & Save, you are signing up for a subscription that renews automatically until you cancel. By subscribing you authorize us, through our payment processor, to charge your payment method for each refill at the subscription price shown at checkout, plus any applicable shipping and taxes, on the schedule you chose:
- 1 bottle every 30 days
- 3 bottles every 90 days
- 5 bottles every 150 days
Your first charge happens when you place your order. You can skip a refill, change your schedule, pause or cancel at any time before your next charge from your account at arlumia.com/account, or by emailing contact@arlumia.com. Cancelling stops all future charges; it does not refund refills that have already shipped, but every order is covered by our 90-day money-back guarantee described in our Refund Policy. If we change the price of your subscription, we will email you before the new price applies, and you can cancel before then.
6. Shipping and delivery
Shipping costs and delivery options are shown at checkout. Orders under $60 ship for a flat rate; orders of $60 or more ship free. Delivery times are estimates and are not guaranteed. Title and risk of loss pass to you when we hand your order to the carrier, but we'll always help if a package is lost or damaged, as described in our Refund Policy.
7. Refunds and returns
Refunds are handled under our Refund Policy, including our 90-day money-back guarantee.
8. Free gifts and promotions
Free gifts (such as our digital guide or cotton gloves) are included with qualifying orders while supplies last and have no cash value. We may change or end promotions at any time; changes don't affect orders already placed.
9. Reviews and feedback
If you send us feedback or post a review, you give us a non-exclusive, royalty-free license to use, reproduce and display it in connection with our business. Reviews must reflect your genuine experience. We do not pay for, edit the meaning of, or selectively remove reviews based on whether they are positive or negative.
10. Intellectual property
All content on the Services, including text, images, graphics, logos and the Arlumia name, belongs to Arlumia or its licensors and may not be copied or used without our written permission, except for your personal, non-commercial use of the store.
11. Prohibited uses
You may not use the Services for any unlawful purpose, to infringe anyone's rights, to submit false information, to interfere with the security or operation of the Services, or to scrape or collect data from the Services by automated means without our permission.
12. Third-party links and tools
The Services may link to or include tools from third parties. We are not responsible for their content, products or practices, and your use of them is at your own risk and subject to their terms.
13. Relationship with Shopify
Arlumia is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Arlumia. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Arlumia, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Arlumia.
14. Disclaimer of warranties
Except as expressly stated by Arlumia, the Services and all products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. Some jurisdictions don't allow these exclusions, so they may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law, Arlumia, Shopify and their affiliates, officers, employees, agents and service providers will not be liable for any indirect, incidental, special, punitive or consequential damages arising from your use of the Services or any product. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Nothing in these Terms limits liability that cannot be limited by law.
16. Indemnification
You agree to indemnify and hold harmless Arlumia, Shopify and their affiliates from claims arising out of your breach of these Terms or your violation of any law or the rights of a third party.
17. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. If you are a consumer living in another country, you also keep the protection of any mandatory laws of your country of residence.
18. Changes to these Terms
We may update these Terms from time to time by posting the new version on this page. Changes apply to orders placed after they are posted. Subscription price changes are handled as described in Section 5.
19. Severability and entire agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and Arlumia regarding the Services.
